It shall be unlawful for any person to dispose of rubbish, trash, leaves, grass, paper, lumber or any other combustible materials by open burning or to cause, allow or permit open burning within the city; Provided, that these restrictions shall not apply to burning in a residential fireplace or in charcoal burners or broilers used in the preparation of food.

The fire chief or his authorized representative may authorize burning through the issuance of a burning permit if such burning is conducted under the circumstances and conditions specified by the fire chief or his authorized representative. Open burning shall be permitted only when it can be shown that such open burning is the only feasible method of disposal and that disposal by burning is in the public interest. Any person intending to engage in such open burning shall request in writing a burning permit from the fire chief or his authorized representative.

Exceptions to Section 7-401, as provided in Section 7-402, shall be by written permit only. Burning permit shall include the following information:
(a) Name, address and telephone number of person submitting the application.
(b) Description of materials to be burned, location of burn site, time of burn.
(c) Reason why open burning is the only feasible method of disposal and why disposal is in the public interest.
(d) Approved burning will only be performed under constant supervision of the applicant or his/her agent.

Any person violating the provisions of this article shall be guilty of a misdemeanor and, upon conviction thereof, be punished by a fine in an amount not less than $25.00 nor more than $100.00.

A Citation may be issued by the local law enforcement officer, fire chief or his authorized representative in any situation where such official observes an illegal fire, whether or not a complaint has been received.

(a) There shall be established for the City of Mound City a “Burn Site” to be controlled and regulated by the City of Mound City, Kansas.
(b) The use of said burn site shall be for residents of the City of Mound City only and non-residents are prohibited from using the same. Materials. that may be deposited at the Mound City burn site shall be limited to bio-degradable material including but not limited to trees; limbs; leaves; weeds and grass clippings. Deposit of any lumber of any kind or any other type of material not specified herein at said burn site is unlawful.
(c) The City of Mound City burn site shall meet all regulations as established by the Kansas Department of Health and Environment.
(d) Any violation of this section shall be penalized with a minimal fine of One Hundred Dollars ($100.00) and a maximum fine of Five Hundred Dollars ($500.00). Each violation shall be considered a separate offense.
